Jared Foley is a partner in M&R’s New York office and the firm’s Class Action & Complex Litigation Practice Group Leader. He focuses on the representation of corporations, shareholders and executives in complex commercial, securities and white-collar criminal actions in state and federal court, as well as in AAA and JAMS arbitrations and in mediations.

Having honed his skills at Weil, Gotshal & Manges, LLP and other notable law firms in NYC, Jared is a quarterback in all aspects of litigation from development of case strategy to appeals. Notably, Jared has argued in the New York State Court of Appeals and in the Second Circuit.

Jared is sought after for his work handling class actions; Unfair Trade Practices disputes; labor, EEOC employment and wage and hour cases; adversary proceedings in bankruptcy court; intellectual property and trade secret litigation; legal and professional malpractice matters; and real estate issues.

While a law student at Columbia University, Jared was a staff editor of the National Black Law Journal

Appellate: In a mortgage foreclosure action involving a major bank, wrote a motion for leave to appeal to the New York State Court of Appeals, which was granted. Then, successfully defeated a motion to dismiss and argued before New York’s highest court, which sustained certain issues and remanded the case to the trial court.
Appellate: Represented an appellant in a case arising from a mortgage foreclosure action. Drafted and filed a motion for reargument or for leave to appeal to the Court of Appeals arguing that the respondent bank did not own the mortgage note at issue and could not sustain its foreclosure action. Once before the Court of Appeals, conducted oral argument and achieved a partial victory where the matter was remanded to the trial court for further proceedings as to whether, under a newly-enacted statute, the bank’s ownership of the note could be challenged.
Appellate: Represented a supreme court judge and former guardian of the plaintiff in an appeal in which the appellant alleged misconduct by the judge. Drafted and filed a motion to dismiss the appeal and request for sanctions, both of which were ultimately granted.
Commercial & Business Litigation: Represented a shareholder in an apartment corporation alleging, inter alia, breach of contract and breach of fiduciary duty. Successfully pursued numerous discovery motions and, following oral argument, obtained summary judgment in the client’s favor on the crucial issues of the case.
Commercial & Business Litigation: Represented a software company in a dispute with the City of New York, wherein it was alleged that the client failed to meet certain milestones for the installation of telecommunications and accounting software. Despite millions of dollars in damages being sought, achieved a substantial settlement that was favorable to the software company.
Employment Litigation: Representing a client fired due to her disability. Engaged in aggressive mediation with opposing counsel and obtained a substantial settlement for the client in advance of trial.
Employment Litigation (Discrimination): Achieved a substantial settlement in favor of an employee who was subjected to racial discrimination and fired due to her disability.
Real Estate Litigation: Represented a condominium board in a civil forfeiture action arising from the 1MDB Malaysian corruption scandal. The dispute concerned whether the acquisition by the U.S. of a luxury penthouse was subject to provisions of bylaws relating to the board’s right of first refusal as to future sales of the property.
Real Estate Litigation: Represented an apartment corporation against a shareholder for breach of contract for blocking the sale of cooperative shares. In response to a motion for summary judgment filed by the plaintiff, drafted and filed opposition papers, conducted oral argument on behalf of the apartment corporation, and defeated the motion, which led to a negotiated settlement of the litigation on favorable terms to the client.
